As you are aware SPLUMA became operative on 1 July 2015 and all transactions, such as sub-divisions, consolidations, Opening of Township and Sectional Title Registries will be affected by the provisions of section 53 of the Act. Once the By-laws of the respective Councils have been promulgated, these by-laws will govern the said acts of registration.
Where a local authority cannot adhere to the said provisions of section 53, until such time as its By-laws have been promulgated, the necessary proof must be submitted to the Registrar of Deeds concerned. Kindly find enclosed Registrar's Circular 9 of 2016 which only relates to the City of Johannesburg, however, the letter can be utilized as a template for other Councils which have not as yet promulgated their By-laws. Also enclosed find Registrars Circular 7 of 2016 which became effective on 2 March 2016 for transactions in the jurisdiction of Tshwane Please do not hesitate to contact us should you need assistance.
